(+) Company restructuring and reorganisation operations are protected by tax regulations by regulating specific concepts (mergers, demergers, value exchanges, business sector contributions and special non-cash contributions). Broseta Abogados places special importance on the tax efficiency of such restructuring operations and, consequently, particular attention is paid to their implementation in order that they may be covered by the specific tax-neutrality legal regulations applicable to such concepts.
Within the interdisciplinary Work Group created at Broseta Abogados to offer complete solutions to family businesses, the tax department offers services that ensure the application of the tax relief available to said companies and their partners, which makes it possible to ensure that taxes are not and will not be an obstacle to the company’s upkeep and transfer from one generation to the next. Also, the situation of individuals with large estates is dealt with by seeking specific individual solutions of great added value to minimise the taxes imposed whilst keeping within the bounds of the current laws.
Another important aspect is our advisory service for foundations and non-profit organisations, a subject in which our lawyers are renowned experts, especially with regard to the legal and tax characteristics of this type of organisation and compliance with the formal and material obligations required by state and regional regulations.
Finally, our tax department carries out the important task of protecting and assisting the interests of taxpayers in tax proceedings brought before the tax administration agencies (state, regional and local) and law courts, particularly proceedings in the tax inspection headquarters. The department defends our clients in proceedings regarding management, inspection and collections, economic-administrative appeals and claims, and litigious-administrative appeals.
