EXPERIENCE

Commercial Lawyer specialising in Competition, Industrial Property, Bankruptcy, Corporate and Insurance Law. Has been part of BROSETA since October 2013, as a Senior Advisor in the Competition and EU Law Department.

Professional experience

Lawyer in the firm of the teachers Manuel Broseta and Alberto Bercovitz between 1986 and 1993, until being appointed Minister of the Generalitat Valenciana.

In 1995 he was appointed member of the Tribunal in Defence of Competition, being its Vice-President between 1998 and 1999.

In 1996, he advised the Secretariat of Industry of Bolivia in the development of a preliminary draft of the law on Competition and Market Management

In June 1999 he was elected a member of the European Parliament. During his parliamentary responsibilities he has been the author of more than twenty reports, many of them legislative, in terms of Competition, Industry and the Internal market (intellectual property, the directives on company reform, take-overs), and has worked closely with Commissioner Mario Monti on the modernisation of the Community system of Competition.

Chairman of the Committee on Industry, External Trade, Research and Energy in 2003.

He has been a member of the Economic Commission on Monetary Affairs and the Committee on Legal Affairs and the Internal Market, and a member of the delegation for relations with the Member States of ASEAN, South-East Asia and the Republic of Korea.

In May 2005 he was appointed a member of the Court of Defence of Competition of Madrid, a position that meant he ceased to be President of the Court of Competition for the Council of Ministers that same year.

Between 2007 and 2011 was the first President of the National Competition Commission.

Until July 2013 has been Special Advisor to the Vice-President of the European Commission, Joaquín Almunia, Head of Competition

Member of the Group of expert advisors of UNCTAD and Chairman of the Editorial Board of Gaceta Jurídica.

He has advised various Competition authorities, including the Dominican Republic, on the implementation of their authority, and, is currently participating in the development of the Central American rules on Competition

Regular lecturer at Universities and forums specialized in Competition.

He has been a Lecturer at the Department of Commercial Law of the University of Valencia (1975-1977), on the subject of Commercial law in the Colegio Universitario de Alicante (1977-1982) and on the Master’s on Community law at the Universidad Complutense, on European law and Professional Practice at the University Carlos III, and Competition Law at the University Juan Carlos I and Arthur Andersen.

President of Section 6 of the Advertising Standards Authority.

Training

Degree in law (University of Valencia, 1968) with Extraordinary Prize for the thesis “Effects for the creditors of the bankruptcy declaration”.
Fellow in the Diputación Provincial de Alicante (1965) at the Faculty of Giurisprudenza in Rome, to write the work “Illicit Civil and illicit criminal”.

Author of more than sixty articles in industry magazines, with special emphasis on Competition.
Has written, in collaboration with the teachers Giner, Parreño & Robles, the work “The new Spanish law before the evolution of the Competition law”.
Published works: “Law of jurisdiction and law of the Retail Market”, “The prohibition of sale to loss” and “Liberalization in Europe: the Myth of Spain”.
